La Verne City Council Unanimously Supports Proposition 36

LA VERNE, CA – During the September 3, 2024, City Council meeting, the City Council voted unanimously to support Proposition 36, known as the Homelessness, Drug Addiction, and Theft Reduction Act. This legislative measure was introduced in response to the significant rise in homelessness, drug addiction, and theft in California following the passage of Proposition 47 in 2014, which reduced penalties for drug possession and theft. Since then, homelessness in California has surged by 51%, with La Verne experiencing a 25% increase in theft and a 172% rise in calls related to homelessness between 2019 and 2023.

Proposition 36, developed by the California District Attorney’s Association, aims to reform the laws that have contributed to these growing issues. Key provisions of the proposition include the introduction of a "treatment-mandated felony" for hard drug possession after two prior convictions, allowing offenders to choose treatment over jail time, and adding fentanyl to the list of hard drugs with increased penalties. The measure also proposes reinstating felony charges for repeat theft offenders and enhancing penalties for "smash and grab" thefts.

Mayor Tim Hepburn emphasized the importance of Proposition 36 for restoring public safety, stating, "Proposition 47 introduced challenges that have significantly impacted our police department's ability to maintain public safety. Proposition 36, however, strengthens our legal framework, enabling us to more effectively address crime. It is crucial that we now focus on safeguarding our community and prioritizing the safety of our residents. Proposition 47 was a misstep, and the rising crime rates underscore the urgent need for change. By supporting Proposition 36, we are committing to ensuring that La Verne remains a secure and protected environment for everyone."

Chief of Police Sam Gonzalez echoed the Mayor’s sentiments, emphasizing the urgency of the measure in light of recent challenges. "We've witnessed a significant rise in homelessness, along with an increase in break-ins and thefts throughout our City. Proposition 36 arrives at a critical moment, providing us with the necessary tools to enact meaningful change, protect our community, and restore a sense of safety for our residents."

Proposition 36 has garnered widespread support, with endorsements from over 350 small businesses, 50 business organizations, 100 elected officials, and 96 public safety leaders across California. The City of La Verne has actively engaged its residents in the discussion, with a vast majority expressing support for the proposition.
